What are these Terms and Conditions?

Please read these terms and conditions carefully as they set out the terms under which shop.boofle.co.uk (the "Website") sells products to you ("Terms and Conditions"). The Website is owned and operated by UK Greetings Limited a company registered at Mill Street East, Dewsbury, WF12 9AW. Our company registration number is 03480710) and our VAT registration number is 168966988 ("we" and "us"; and "our" shall be construed accordingly). By purchasing products available on this Website, you as the customer will transact with us.

These Terms and Conditions should be read alongside, and are in addition to, our Privacy Policy ("Privacy Policy") and our Terms of Use ("Terms of Use") both of which can be found on the homepage of the main boofle.co.uk website. Use of your personal information submitted to or via the Website is governed by our Privacy Policy.

We recommend that you print off and keep a copy of these Terms and Conditions for your future reference. By purchasing any product available on this Website, you agree that you have read, understood and agree to these Terms and Conditions, the Privacy Policy and the Terms of Use in their entirety (including as amended from time to time). If you do not agree to these Terms and Conditions, you must not purchase any product available on this Website.

Placing your order

To place an order you may either create a password protected account or shop as a guest.

When you upload or create content to be included within personalised products, you must comply with our Content Standards under the Terms of Use.

Products may be ordered by clicking on the items you wish to purchase and then following the prompts that will appear on-screen. You may check and correct any input errors in your order up until the point at which you submit your order to us by clicking the "Pay Now" button on the checkout page.

By placing an order through our Website, you warrant that you are legally capable of entering into binding contracts and you are at least 18 years old. You must also be located in the UK.

After placing an order, you will receive an acknowledgment from us that we have received your order and giving you an order reference number. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy the product(s) ordered. All orders are subject to acceptance by us. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by clicking on the ["Pay Now"] button you enter into an obligation to pay for the product(s). Where we accept your order, we will confirm such acceptance by sending you a confirmation email ("Order Confirmation").  Subsequently we will send you a second email when your order has been despatched.  The contract between you and us is in relation to the product(s) ordered ("Contract") and will only be formed when we send you the Order Confirmation.

 The Contract will relate only to the product(s) which have been confirmed in the Order Confirmation. We will not be obliged to supply any other product(s) which may have been part of your order until such product(s) have been confirmed in a separate Order Confirmation.

 Prices

The prices payable for the items that you order are clearly set out on this Website. All prices are expressed inclusive of any VAT payable. Prices can change and we endeavour to keep our prices updated at all times.

Availability

If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible. We will contact you to confirm that you are happy to proceed with the order and agree to wait for the original product(s) or would like to select an alternative product.

Supply of Goods

The cards and other products sold by us through our Website are manufactured by a range of different in-house and third-party production facilities.

Payment & Security

You can pay with  MasterCard, Maestro, Visa Electron or Visa Debit card, or via Apple Pay and Google Pay. Your payment card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. Payments for products will be itemised on your bank statements as showing payment to UK Greetings Ltd

The purchase on our website will be made in pounds Sterling.

Delivery

Delivery will be made to the UK address specified by you. We will make reasonable endeavours to despatch orders received before 2pm on the same day: orders received after 2pm on the following day; and orders received after 2pm on Friday to Sunday inclusive (or on public holidays) on the next working day.  All card orders will be delivered by Royal Mail and Parcel Force (or other commercial carrier at our discretion).

Consumer cancellation rights

You will not have any right to cancel a Contract for the supply of any of products that have been personalised or made to your own bespoke specifications.

Except in relation to certain products set out above, you may cancel a Contract at any time before your order is delivered and up to 14 days afterwards, beginning on the day after your order (in its entirety) is delivered to you ("Cooling-Off Period").

If you cancel, you will receive a full refund of the price paid for the product(s) in accordance with our Refunds policy (see below).

To cancel a Contract, you must clearly inform us, preferably:

•     in writing, giving us your name, address and order reference; or

•     by emailing or calling our customer services team.  The phone number is 01924 436320 and the email is enquiries@shop.boofle.co.uk

You must also return the product(s) to us within 14 days after the day of notifying us of the cancellation, in the same condition in which you receive them (which does not interfere with your right to take any reasonable steps to examine the product(s) and make sure they conform to your order). You have a legal obligation to take reasonable care of the product(s) while in your possession. If you fail to comply with this obligation, we may have a right to deduct the cost of any deterioration (due, for example, to your having used the product(s) such as by having written in a greeting card), up to the price of the product(s), from the refund to which you are otherwise entitled.

To return the product(s), you should package the parcel securely making sure you include a note of your name and address inside the parcel and then return it to us, either by courier or by recorded delivery mail or other form of certified mail or, if the product(s) are too bulky to return by mail, then by a suitable carrier, to the following address:

Details of the consumer rights described above, and an explanation of how to exercise them, are provided in the Order Confirmation. Nothing in this section affects your legal rights.

Refunds

If you cancel a Contract between us within the 14-day Cooling-Off Period (see above), we will process any refund due to you as soon as possible and, in any case, within 14 days after the day on which we receive the product(s) back or, if earlier, the day on which we receive evidence that you have returned the product(s) to our returns address (see above). We will refund the price paid in full (subject to any deduction we are entitled to make due to your use of or damage to the product(s)), including the cost of standard delivery. We will not refund your cost of returning the product(s) to us. If you received any promotional or other discount when you paid, any refund will only reflect the amount you actually paid.

We are unable to accept returns or provide refunds for print on demand or personalised products, unless the product is defective, or we are otherwise in breach of our agreement with you and are obliged to do so.

We will refund any payment received from you using the same method originally used by you to pay for your purchase.

Faulty Products

Goods must be fit for purpose and of satisfactory quality. If any product you order is damaged or faulty when delivered to you or has developed a fault, you may have one or more legal remedies available to you, depending on when you make us aware of the problem, in accordance with your legal rights. If you believe a product was delivered damaged or faulty or has developed a fault, you should inform us as soon as possible, preferably in writing by email, giving your name, address and order reference. Nothing in this section affects your legal rights.

Liability

To the fullest extent permitted by applicable law, our liability to you in respect of an order shall not exceed the greater of (a)  the value of that order, or (b) £100, and we shall not be liable to you for any indirect, consequential, special or punitive loss, harm or damage (including economic loss, loss of profit, loss of revenue, loss of business, wasted expenditure or depletion of goodwill) whatsoever or howsoever caused, including, without limitation, as a result of our negligence.

For the avoidance of doubt nothing in these Terms and Conditions excludes or limits our liability in respect of death or personal injury caused by our negligence; under section 2(3) of the Consumer Protection Act 1987; or for fraud or fraudulent misrepresentation.

If using a public computer or terminal, always close the browser when you complete an online session.

We will never ask you to confirm any account or credit card details via email and if you receive an email claiming to be from https://shop.boofle.co.uk asking you to do so then please ignore it and do not respond.

Except as expressly set out in these Terms and Conditions, all implied warranties and representations (whether implied by statute, custom, common law or otherwise) are excluded to the fullest extent permitted by law. 

The exclusions shall not apply if the goods you receive do not, in all material respects, meet the specifications as described in the order.

Written Communication

Applicable laws require that some of the information or communications we send to you should be in writing. When using our Website, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our Website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Our Right to Vary these Terms and Conditions

We reserve the right to change these Terms and Conditions from time to time by changing them on the Website, although no such change will affect any order you have already placed with us.

General

The Contract between you and us is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event"). Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

No failure or delay by us to exercise any right or remedy provided under a Contract or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

These Terms and Conditions and any document expressly referred to in them represent the entire agreement between you and us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing. You and we both acknowledge that, in entering into any Contract, you and we have not relied on, and shall have no right or remedy in respect of, any statement, representation, assurance or warranty (whether made negligently or innocently) other than as expressly set out in these Terms and Conditions (and any document expressly referred to herein). Nothing in this clause shall limit or exclude any liability for fraud.

 

These terms shall be governed by English law, except that if you are a consumer and not a business user and if you live in Scotland or Northern Ireland, there may be certain mandatory applicable laws of your country which apply for your benefit and protection in addition to or instead of certain provisions of English law.

You agree that any dispute between you and us regarding these Terms and Conditions or any Contract will only be dealt with by the English courts, except that if you are a consumer and not a business user and if you live in Scotland or Northern Ireland, you can choose to bring legal proceedings either in your country or in England, but if we bring legal proceedings, we may only do so in your country.

If any of these Terms and Conditions are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law. Only you and we shall be permitted to enforce these Terms and Conditions.
